class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li><b> Purpose\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">1.1 The purpose of this Charter is to set out the role, responsibilities and relationships of\u00a0 the Kahuranaki Marae Committee to the hapu and descendents of the Marae.\u00a0<\/span><\/p><ol start=\"2\"><li><b> Iwi and Hapu Affiliations\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">2.1 The Iwi that this Marae acknowledges is Te Whatuiapiti and Ngati Kahungunu whanui although other iwi and hapu also have acknowledged connections.\u00a0 2.2 The predominant hapu identified for this marae is Ngai Te Rangikoianake.\u00a0<\/span><\/p><ol start=\"3\"><li><b> Name and Location\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">3.1 The name of the organisation shall be Kahuranaki Marae Committee.\u00a0 3.2 The premises and facilities administered by the organisation are located at Te Hauke,\u00a0 1864 State Highway 2, R.D. 11, Hastings 4178, Hawkes Bay.\u00a0<\/span><\/p><ol start=\"4\"><li><b> Legal Description\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">4.1 The legal description of the land administered by the Kahuranaki Marae Committee\u00a0 is the Poukawa (Marae) Maori Reservation which incorporates the blocks known as\u00a0 Poukawa 11W, 11U, 11T and 11N1. The Trustees acknowledge those owners who\u00a0 gave land towards the reservation and encourage their involvement in the\u00a0 Committee.\u00a0<\/span><\/p><ol start=\"5\"><li><b> Management\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">5.1 Kahuranaki Marae Committee shall also be known as Trustees of the Marae referred\u00a0 to as the \u2018Committee\u2019. The Kahuranaki Marae Committee will fulfil their trustee\u00a0 responsibilities under the Te Ture Whenua Act 1993 as Trustees and the Maori Community Development Act 1962 as a Maori Committee.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">5.2 The general responsibilities of the Kahuranaki Marae Committee in respect of the <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">local Maori\/ hapu shall be:<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(a) To maintain and administer the marae complex\/ reservation to a standard <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">that allows the hapu to satisfactorily apply their tikanga:<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(b) To consider and discuss such matters as appear relevant to the social, <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">cultural and economic advancement of the local Maori\/ hapu:<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(c) To consider and, as far as possible, give effect to any measures that will <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">conserve and promote harmonious and friendly relations between members <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">of the local Maori\/ hapu and other members of the community:<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(d) To promote, encourage, and assist local Maori\u2014<\/span><\/li><\/ul><\/li><\/ul><ul><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(i) To conserve, improve, advance and maintain their physical, <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">economic, industrial, educational, social, moral, and spiritual well being;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(ii) To assume and maintain self-reliance, thrift, pride of race, and <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">such conduct as will be conducive to their general health and <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">economic well-being;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(iii) To accept, enjoy, and maintain the full rights, privileges, and <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">responsibilities of New Zealand citizenship;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(iv) To apply and maintain the maximum possible efficiency and <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">responsibility in their local self-government and undertakings; and<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(v) To preserve, revive and maintain the teaching of Maori arts, crafts, <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">language, genealogy, and history in order to perpetuate Maori <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">culture:<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(e) To collaborate with and assist Government Agencies and other <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">organisations in\u2014<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(i) The placement of local Maori in industry and other forms of <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">employment;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(ii) The education, vocational guidance, and training of Maori;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(iii) The provision of housing and the improvement of the living <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">conditions of Maori;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(iv) The promotion of health and sanitation amongst the local Maori <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">people;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(v) The fostering of respect for the law and law-observance amongst <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">the local Maori people;<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(vi) The prevention of excessive drinking and other undesirable forms <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">of conduct amongst the local Maori people; and<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">(vii) The assistance of local Maori in the solution of difficulties or <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">personal problems.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><\/ul><\/li><\/ul><\/li><\/ul><ol start=\"6\"><li><b> Election Process and the Appointment of the Kahuranaki Marae Committee <\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.1 Elections for members shall be held at Kahuranaki Marae.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.2 All <\/span><b>persons <\/b><span style=\"font-weight: 400;\">of Ngai Te Rangikoianake descent and\/or with a direct affiliation to the\u00a0 Marae can take part in electing the Committee Members.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.3 All <\/span><b>persons <\/b><span style=\"font-weight: 400;\">of Ngai Te Rangikoianake descent and\/or with a direct affiliation to the\u00a0 Marae are eligible for appointment, except for those who have been removed by an\u00a0 order of the Maori Land Court.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.4 The Marae Committee shall be elected by the hapu in accordance with <\/span><b>Schedule 1. <\/b><span style=\"font-weight: 400;\">6.5 Any disputes regarding eligibility to vote and\/or be nominated, shall be resolved by\u00a0 the outgoing Marae Committee.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.6 The election results are to be noted in the records of the Maori Land Court, Takitimu\u00a0 District within one calendar month of the elections.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.7 The importance and special place of Kaumatua within this structure is acknowledged. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">They should always be given the opportunity to convey their opinion and guidance to <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">the Trustees.<\/span><\/p><p><b>6.8 Membership<\/b><b>\u00a0<\/b><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">The Kahuranaki Marae Committee shall be made up of thirteen (13) members. As a <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">guide, the committee could consider representation from:<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">The wh\u00e4nau who bequest the lands<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Kaum\u00e4tua duly elected by them<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Rangatahi focused members<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Maintenance\/ marae buildings\/ grounds focused<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Administrators<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Hapu development focused members<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Planners and fundraisers<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.8 The newly elected Committee must complete and submit a consent order, within\u00a0 one month of the triennial hui elections, with the Maori Land Court confirming the\u00a0 names and position holders of the new Trustees.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">6.9 On receipt of the endorsed consent form from the Maori Land Court the Trustees\u00a0 must publish within seven (7) days confirmation of their appointment in a local\u00a0 newspaper.\u00a0<\/span><\/p><ol start=\"7\"><li><b> Meetings\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.1 The Committee must hold a minimum of ten general Committee meetings per year,\u00a0 or at any other mutually agreed time, for the purpose of on-going management of\u00a0 the Marae.\u00a0\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.2 The first meeting of the Committee shall be held within thirty days of their\u00a0 appointment.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.3 Only the members can vote at any general Trustee meeting. Voting will be by a\u00a0 show of hands unless otherwise requested.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.4 All descendants shall be entitled to attend any of the general Committee meetings,\u00a0 provided that their presence does not detract from the purpose of the Committee or\u00a0 the purpose of the meeting.\u00a0\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.5 A quorum of 60% of the Committee must be in attendance before the meeting is\u00a0 opened so that any decisions made are binding.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.6 If a quorum is not established at the meeting, the meeting may proceed, but any\u00a0 decisions made shall not be binding until ratified by a majority of the Committee. 7.7 All decisions shall be decided by a majority of votes of the Committee present at the\u00a0 meeting.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.8 The Chairperson shall have a deliberative vote and also, in cases of a tie of votes on\u00a0 any matter, a casting vote.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.9 In the absence of the Chairperson, the Deputy Chairperson shall chair the meeting\u00a0 and shall have a deliberative vote and also a casting vote.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.10 The voting process shall be by a show of hands unless otherwise agreed by majority\u00a0 of Committee.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.11 If a member fails to attend three (3) consecutive regular meetings and also fails to\u00a0 submit their apologies to the Chairperson or Secretary, that <\/span><b>member <\/b><span style=\"font-weight: 400;\">will be deemed to have resigned, unless <\/span><b>she\/he <\/b><span style=\"font-weight: 400;\">have been granted special leave of absence <\/span><b>by the\u00a0 Committee.<\/b><\/p><p><b>Annual General and Special Meetings<\/b><b>\u00a0<\/b><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.12 Annual General Meetings will be held within three (3) months of the end of the\u00a0 financial year. The purpose of the annual general meeting is to:\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">present the Year End Financial Statements and notify Hapu of the\u00a0 Chartered Accountant who has reviewed and\/or audited the annual\u00a0 accounts.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">present an account of the achievements of the year\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">present an annual plan for the coming year\u00a0<\/span><\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">7.13 Special general meetings may be called by the Committee at any time as seen\u00a0 necessary where input is required by the Hapu.\u00a0\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">A special general meeting must be called if the number of original\u00a0 elected Committee falls below 60%.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Notification of hui will be done in the same manner as for the\u00a0 Triennial hui \u2013 refer Sections 6.4 and 6.5 of this document. In the case\u00a0 of special general meetings, the notice period of twenty one (21) days\u00a0 may be waived where an emergency exists. In this case at least all\u00a0 Committee are notified as a matter of urgency.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">A minimum quorum of 60% of the Committee and (number of\u00a0 descendents) of the Marae shall be present before voting is allowed. Voting will be by a show of hands unless otherwise requested by the\u00a0 majority of attendees.\u00a0<\/span><\/li><\/ul><\/li><\/ul><ol start=\"8\"><li><b> Duties and Behaviour of Committee\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">Committee must\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">8.1 Act in good faith in exercising their powers.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">8.2 Administer Kahuranaki Marae:\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">for the benefit of descendents\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">for those entitled to use and enjoy Kahuranaki Marae\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">in accordance with the Maori Reservations Act 1994 and Te Ture Whenua Act\u00a0 1993.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">In accordance with other relevant legislation.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">8.3 Committee members cannot delegate their authority.\u00a0<\/span><\/p><ol start=\"9\"><li><b> Committee Code of Conduct\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">9.1 All Committee must work together for the betterment of the Marae. 9.2 All Committee members must uphold mana Atua, mana Tangata, mana whenua,\u00a0 mana Rangatiratanga.\u00a0<\/span><\/p><p>10.<b> Power of Committee\u00a0<\/b><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">10.1 The Committee of Kahuranaki Marae will by majority resolution: <\/span><span style=\"font-weight: 400;\">\u2219 <\/span><span style=\"font-weight: 400;\">authorise activities on the reservation to any person or whanau or group <\/span><span style=\"font-weight: 400;\">\u2219 <\/span><span style=\"font-weight: 400;\">issue permits in relation to any activity on the Marae<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">apply to the Court for any directions in relation to the administration of the\u00a0 reservation and the powers and obligations of the Committee\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">call meetings of interested persons in relation to the administration of the\u00a0 reservation\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">appoint and employ, on behalf of the Committee, such advisers, as the\u00a0 Committee think fit, for the purposes of enabling their better administration of\u00a0 the reservation.\u00a0<\/span><\/li><\/ul><\/li><\/ul><ol start=\"11\"><li><b> Committee Responsibilities and Administration\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">11.1 The Committee shall be responsible for the efficient and effective running of the\u00a0 Marae, although they may delegate the day to day functions and responsibilities.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">11.2 The Committee must ensure tikanga and kawa of the Marae is maintained by :\u00a0 <\/span><span style=\"font-weight: 400;\">\u2219 <\/span><span style=\"font-weight: 400;\">maintaining contact with Ngai Te Rangikoianake Kaumatua\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">supporting Kaumatua in ensuring Manuhiri and Tangata Whenua are\u00a0 informed of the tikanga and kawa:\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">providing clear direction on the use of the Marae Atea and other\u00a0 whenua associated with Kahuranaki Marae for hui and tangihanga;\u00a0 and\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">supporting whanau to maintain the Urupa.\u00a0<\/span><\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">11.3 The Committee must keep and maintain accurate and up to date records and\u00a0 accounts in relation to the administration of Kahuranaki Marae.\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">The Committee shall maintain a bank account into which all money\u00a0 received for Kahuranaki Marae\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">The Secretary shall be responsible for keeping a minute book of all\u00a0 Committee meetings and resolutions. She\/he shall also maintain all\u00a0 records related to the administration of Kahuranaki Marae\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">The Treasurer will be responsible for the maintenance of all financial\u00a0 records of Kahuranaki Marae.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">To operate Kahuranaki Marae Committee bank accounts, two (2) out\u00a0 of three (3) signatories are required. The signatories must consist of\u00a0 the Treasurer\/Chairperson and one other trustee perhaps the\u00a0 Secretary\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Any applications for funding must first be presented to the Committee at a general meeting and authority to proceed confirmed by a\u00a0 resolution of the Committee at a general meeting\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">All documents that involve the acquisition of money must be signed\u00a0 by the Treasurer, Secretary or Chairperson\u00a0<\/span><\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">11.4 The Committee shall also be represented on each sub-committee (portfolio) of\u00a0 Kahuranaki Marae as an advisory member of that sub-committee. Their primary role\u00a0 is to work with the sub-committee members to ensure that all communication is\u00a0 open and honest.<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">11.5 The Committee will require that other Committees\/Organisations operating on the\u00a0 Marae, inform the Committee of:\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">any activity likely to affect the Marae;\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">any activity likely to have financial implications on hapu of the Marae;\u00a0 and\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0any long-term (more than 3 years) affect on the Marae or its whenua. <\/span><\/li><li><span style=\"font-weight: 400;\">11.6 A duly appointed representative elected by the Committee will represent the Hapu\u00a0 on all relevant Iwi Committees.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">11.7 All persons who cease to hold office as a member due to retirement or removal must\u00a0 return all records and documents collated during their term as member of\u00a0 Kahuranaki Marae Committee. Such persons shall be released from any liability\u00a0 unless he\/she were the instigator and\/or participant in any incident, while holding\u00a0 office that gave rise to the liability action.\u00a0<\/span><\/li><\/ul><\/li><\/ul><ol start=\"12\"><li><b> Limitations of Committee Abilities to Administer the Land\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">In accordance with Te Ture Whenua Maori Act 1993 the Committee:\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">12.1 Cannot sell, gift, exchange or mortgage land that comes under the reservation. <\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">12.2 Can only grant leases or occupational licenses of the land for up to fourteen (14)\u00a0 years. The exception to this rule is in the case where land is used for the purpose of\u00a0 education or health.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">12.3 Must obtain the consent of the Maori Land Court for any lease or licence that\u00a0 exceeds three (3) years.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">12.4 Any revenue from the lease or licence must be used as directed by the Maori Land\u00a0 Court.\u00a0<\/span><\/p><ol start=\"13\"><li><b> Delegation of Authority\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">13.1 In his\/her absence the Chairperson may nominate any member to chair a meeting or\u00a0 attend hui on his\/her behalf.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">13.2 The Committee can co-opt onto the committee descendants to complete specific\u00a0 projects or provide specialist advice. Co-opted members are not eligible to vote at\u00a0 general meetings.\u00a0<\/span><\/p><ol start=\"14\"><li><b> Constitution\u00a0\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">14.1 This Charter forms the Constitution for the Kahuranaki Marae Committee. 14.2 The Committee must ratify all policies, rules and guidelines of the Kahuranaki Marae Committee.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">14.3 The Committee can ratify or if need be, call a hapu hui <\/span><b>to ratify <\/b><span style=\"font-weight: 400;\">rules, regulations and\u00a0 guidelines <\/span><b>of the Kahuranaki Marae Committee.\u00a0<\/b><\/p><ol start=\"15\"><li><b> Strategic Plan\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">15.1 A Marae development plan may be prepared for Kahuranaki Marae, but it will\u00a0 remain a separate document from this charter.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">15.2 The plan will be maintained and reviewed by the Committee.\u00a0<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">15.3 The plan does not need to be registered with the Maori Land Court or any other\u00a0 official body.<\/span><\/p><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">15.4 The purpose of the plan shall be to enable the Committee to plan future\u00a0 development, based on the history of Kahuranaki Marae and the needs of the hapu.\u00a0\u00a0<\/span><\/p><ol start=\"16\"><li><b> The Charter\u00a0<\/b><\/li><\/ol><p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">16.1 This charter:\u00a0<\/span><\/p><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Shall be kept at the Marae and\/or available from the Committee.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Any amendments to this Charter must be approved and ratified at a special\u00a0 general meeting.<\/span><\/li><\/ul><\/li><\/ul><p><b>Schedule 1<\/b><b>\u00a0<\/b><\/p><p><span style=\"font-weight: 400;\">Election Process. (Reference- Maori Community Development Regulations 1963, Regulation <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">3). <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2219 <\/span><span style=\"font-weight: 400;\">(1) At least two weeks before the last Saturday in February in the year 1964 and at <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">least two weeks before the corresponding day in every third year thereafter, each <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">functioning Committee shall, by public notice in a newspaper circulating in its area or <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">in such other or additional manner as it thinks will adequately inform the <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Whanau\/hapu\/community in its area, call a public meeting of <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Whanau\/hapu\/community residents for the purpose of electing members of the <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Committee for the ensuing three years. A register of such people present shall be maintained and <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">numbered voting forms shall be issued to each eligible voter. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">(3) At any such meeting the Chairman of the outgoing Marae Committee shall <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">preside\/facilitate unless the committee choose otherwise. If the Committee <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Chairman is not chosen to preside\/facilitate the meeting the members must <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">designate the chairman\/facilitator. If no chairman\/facilitator is so chosen a <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">chairman\/facilitator shall be elected by the meeting.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">(4) Written nominations for election signed by the nominator and seconder and <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">accepted by the nominee may be lodged with the Committee before the meeting <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">and verbal nominations may be made and seconded at the meeting.<\/span><\/p><p><span style=\"font-weight: 400;\">8\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Presented to the hapu 28<\/span><span style=\"font-weight: 400;\">th <\/span><span style=\"font-weight: 400;\">March 2012\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">(5) If the number of nominations received does not exceed the number of persons <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">required to be elected, those persons shall be declared to be elected.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">(6) If more nominations are received than the number of persons required to be <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">elected, a ballot shall be conducted amongst those present who are entitled to vote. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">At any such ballot no person&#8217;s vote shall be counted if he votes for more than the <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">number of persons requiring to be elected but a vote for fewer than that number <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">shall not be invalid.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">(7) Where a ballot is held, the meeting shall appoint two adult persons present to be <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">scrutineers to check and count the votes. Unless there are insufficient other adult <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">persons present, no person who has been nominated for election and no wife or <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">husband or civil union partner or de facto partner of any such person shall be <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">appointed as a scrutineer.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">(8) The nominees up to the number required to be elected who receive the highest <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">number of votes shall be deemed to be elected. If there is an equality of votes <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">amongst a group of nominees who could not all so be declared to be elected without <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">exceeding the number of vacancies, a further ballot shall be taken amongst the <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">members of that group to determine which of them shall be elected, and, if the <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">second ballot does not result in a decision, the chairman of the meeting may <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">exercise a second or casting vote.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">(9) All other questions arising at any such meeting shall be decided by a majority of <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">the votes of those present and entitled to vote. In the event of an equality of votes <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">the chairman of the meeting shall have a second or casting
